Two operators of an assisted living facility in Arapahoe County have been indicted, the 18th Judicial District Attorney's Office announced on Monday.
On Thursday, a grand jury returned an indictment charging James Russell Vogel and Angelica Vogel, operators of All Saints Home Care in the 6500 block of South Lisbon Court, with:
- Two counts of attempt to influence a public servant
- One count of false imprisonment of an at-risk adult
- Three counts of caretaker neglect
All Saints Home Care is an unlicensed care facility and offers assisted living and memory care to older adults, an arrest affidavit says. The facility operated out of a private home where the Vogels live, and they are the primary caregivers for the residents, the affidavit says.
On Nov. 18, 2025, a resident was left unsupervised long enough by the Vogels for her to climb through a second-story window and become stranded on the roof of the residence, according to the affidavit. The woman slipped down the roof and part of her body was over the roof edge when a neighbor saw and called 911. The neighbor then helped Jason Vogel by preventing the resident from slipping further until Arapahoe County Sheriff's Office deputies arrived and got woman back through the window, the affidavit reads.
Four days later, the woman's family member learned about her being rescued by first responders from the roof as a video had been posted on social media showing the rescue. When the family member arrived, no one answered the front door, so they went around to the back of the property and saw her alone and restrained in a wheelchair inside the house, the affidavit reads.
The family member entered the house since it was unlocked and saw that the woman was tied into the wheelchair by a harness that was secured by a zip tie, the affidavit says. The family member then cut her free and removed her from the home. The Vogels weren't present at the home when the family member did this, and the family member only saw one other caregiver who appeared to be dealing with other residents, the affidavit says.
In November, the family of the woman told 9NEWS that All Saints Home Care and the Arapahoe County Sheriff’s Office didn't contact the family about the incident.
At the time, ACSO deputy John Bartmann told 9NEWS over email, "We generally do not notify someone involved in an incident if we are going to release footage as long as that footage is redacted and the person is not identified."
He added that the goal of the video was to highlight the quick work of ACSO deputies in rescuing the woman.
In an incident earlier this year, a caseworker from Arapahoe County Adult Protective Services went to the facility after receiving a complaint from an unknown person. The caseworker couldn't find one of the residents of the care facility, the affidavit says. The Vogels told the caseworker the man's family had moved him to a different facility, but said they didn't know where the man had been moved to.
When the caseworker notified the family, they went to All Saints Home Care and removed the man from the Vogels' care, the affidavit says.
The man was then taken to the hospital, where a forensic nurse examination was carried out, according to the affidavit. The examination found that the resident had bruises on his chest, arms and on other areas of his body. The resident was also "extremely thin" and had signs of other neglect, the affidavit says.
When the resident was removed from the care facility, the family was given a bag of medication bottles by Angelica Vogel. The sheriff's office found prescription bottles belonging to other residents mixed in with the man's and at least one container with pills that didn't match the prescriptions on the label, the affidavit reads.
Further investigation showed the man hadn't been seen regularly by a doctor for medical care prior to him being admitted to the hospital, the affidavit states.
In another incident from September, officials from the Colorado Department of Public Health and Environment came to All Saints Home Care to check on the facility, residents and compliance for unlicensed care facilities, the affidavit says. One of the residents who had a complaint wasn't there, and the Vogels told the CDPHE official that the resident moved out and no longer lived at the residence, according to the affidavit.
When the CDPHE officials left, they sat in a vehicle and saw a car drive up into the driveway. They called the sheriff's department and the deputy who responded was able to confirm the resident the Vogels said no longer lived there was in the car and returning home, the affidavit states.
An Arapahoe County Sheriff's Office news release from Saturday said as part of the investigation, several residents were relocated from the facility on Friday and are receiving care somewhere else. Investigators are working to identify people who may have received "concerning care" at the facility, according to the release.
