Texas 10 most wanted fugitive captured near Broken Bow Lake in McCurtain County, OK

MCCURTAIN COUNTY, Ok. (KTAL/KMSS) – A fugitive on the Texas 10 Most Wanted List is now in custody after being arrested at a remote campsite near Broken Bow Lake in McCurtain County, Oklahoma.

According to the Texas Department of Public Safety, James Lee Kirby, 49, was taken into custody on July 17, just over a week after announcing he was added to the list.

According to Texas DPS, members of the U.S. Marshals Service Eastern District of Oklahoma Violent Crime Fugitive Task Force and the U.S. Marshals Joint East Texas Fugitive Task Force, with tactical assistance from the Oklahoma Highway Patrol Tactical Team, located and arrested Kirby without incident.

Kirby was wanted since February of this year out of Bryan County, Oklahoma, for failure to appear on prior charges of first-degree rape and incest.

According to Texas DPS, on June 2, another warrant was issued out of Grayson County, Texas, for his arrest for one count of aggravated sexual assault and two counts of sexual assault.

On Nov. 5, 2024, Kirby was arrested in Grayson Co. for aggravated sexual assault.

DPS says several weeks later, he posted bond and was released from jail.

In early 2026, while Kirby was on pre-trial release for the first-degree rape and incest charges out of Oklahoma, his GPS monitoring device stopped operating right before the trial date, and he has been missing ever since.
