One of America’s most infamous murder convictions is facing a fresh challenge, with Scott Peterson‘s lawyers arguing “new evidence” could help overturn his conviction in the killing of his pregnant wife, Laci Peterson, nearly 22 years later.

Ninette Toosbuy, who appears in A&E’s two-part docuseries Scott Peterson: The New Evidence, said investigators never worked the case like a standard missing person investigation, which requires running down every lead on when and where the person was last seen.

“When you initially have a missing person’s case, there are certain protocols, certain things that must be done, and that is to follow up on every possible lead to determine when and where the missing person was last seen,” she told Fox News Digital on Saturday, July 18.

Toosbuy added, “That wasn’t done in this case. That alone, just that alone, got me very interested in looking deeper into the matter. I think that Scott Peterson does deserve a new trial. I think any individual who’s not given a fair trial to begin with deserves that. That is our system in the United States. A new trial would be the right course of action.”

The docuseries identifies 15 people who said they saw Laci walking the couple’s dog, McKenzie, on the morning of December 24, 2002 — the day her family reported her missing. The timing is significant because the alleged sightings would have occurred after Scott, then 30, said he left home for a fishing trip in San Francisco Bay, as per Page Six.

Toosbuy argued that corroborating even a handful of those accounts could have eliminated him as a suspect. Prosecutors have long maintained the reports were inconsistent and unreliable.

Scott’s attorneys also point to a burglary reported across the street from the couple’s home that same morning, along with a burned-out van found a mile away the next day containing a mattress with what appeared to be bloodstains, as per People. The defense theory suggests Laci may have walked in on the break-in and been abducted.

As In Touch has reported, Sharon Rocha, Laci’s mother, has dismissed the new claims in the documentary outright. “There is no new evidence,” she said, as per People.

Scott, now 53, remains behind bars. Laci was eight months pregnant with the couple’s son, Conner, when she vanished from their Modesto, California, home on Christmas Eve 2002.

Scott joined the early search efforts, but suspicion turned toward him once investigators learned of his affair with Amber Frey. The bodies of Laci and her unborn child washed ashore in San Francisco Bay four months later, and Scott was arrested within days. He has insisted from the start that he was fishing when his wife disappeared.

A trial that gripped the country ended in November 2004 with Scott convicted of first-degree murder in Laci’s death and second-degree murder in Conner’s. He was sentenced to death the following year, but that sentence was overturned in 2020. He was resentenced to life in prison without the possibility of parole in 2021.
