Jelly Roll and Bunnie Xo are disregarding their lawyers’ advice about a life-changing decision amid their divorce.
The country star, whose real name is Jason DeFord, and podcaster, who recently finalized their divorce after a decade of marriage, still plan to have children together despite being “separately advised” by their respective lawyers to not have children together as a divorced couple, according to their marital dissolution agreement obtained by PEOPLE.
The former couple, who had previously discussed welcoming a child via surrogate and do not share any children, were told by their respective counsel that there could be “consequences” to having a baby together “due to evolving technology and case law; as well as the ‘interim category’ of interest afforded to said genetic materials.”
Bunnie Xo, whose real name is Alisa DeFord, and Jelly Roll did acknowledge that their lawyers are not experts “with regard to genetic and reproductive rights,” per court docs, and were “directed and advised” to seek advice from a “qualified expert counsel” outside their lawyers.
The former couple ultimately had “specifically chosen not to seek such counsel,” per the filings.

The “Beautifully Broken” singer filed for divorce from Bunnie Xo on May 18, according to court documents obtained and reviewed by Entertainment Weekly. The date of separation was listed as May 9.
The court docs cite “irreconcilable differences” as the reason for their divorce, noting that the “parties are unable to live together successfully as husband and wife.”
Their divorce comes three months shy of their 10th wedding anniversary after the former couple tied the knot in Las Vegas in August 2016.

After news of their divorce broke, Bunnie Xo said that she and Jelly Roll still hope to have a baby together.
“So, we have been the most unconventional couple that you guys have ever encountered,” she said on the June 18 episode of her Dumb Blonde podcast. “We’re going to co-parent together. J is my best friend. Like, this isn’t what you guys think this is. Nobody cheated on the other person. It’s literally just we served our purpose for each other.”
She also mentioned their plan to welcome a child in her memoir Stripped Down, published in February, and that the former couple had identified a surrogate.
“I’ve waited this long to have kids with someone I knew would be a great father —and to be able to make sure they have the best life,” Bunnie Xo said. “We’re going to raise these babies in love and give them everything we were never given. I can’t wait to see a piece of me and him running around outside of our bodies.”
She continued, “With how much IVF has advanced over the years and with the help of the most unselfish woman willing to carry twins for us, we’ll be able to make our baby dreams come true.”
