The D.C. Circuit has denied former President Joe Biden's emergency bid to stop the DOJ from releasing Special Counsel Robert Hur's interview transcripts and audio recordings.
The Heritage Foundation had filed a Freedom of Information Act request to obtain the materials.
The majority ruled that Biden failed to show he was likely to succeed on the merits of his request, and the public has a strong interest in evaluating Hur's decision not to charge him, SCOTUS Wire reported.
The materials will still be held, at least for a while. The court extended the temporary injunction through Aug. 3 to give Biden time to seek emergency relief from the Supreme Court.
