PINELLAS PARK, Fla. (WFLA) — A St. Petersburg man was arrested on a charge of capital sexual battery after a 12-year-old gave birth to his child, according to police.

A Pinellas Park police statement said that at about 10:30 p.m. on July 16, officers responded to Helen Howarth Park after a baby was born there.

The baby and the mother, a 12-year-old girl, were taken to a hospital for treatment. Because of the circumstances, officers began investigating how the child got pregnant in the first place.

Detectives said the 12-year-old was not aware she was pregnant before the birth, but she told authorities she was sexually battered and molested by her uncle, 62-year-old Delfin Back, multiple times over the last year at a home in Pinellas Park.

“As a result of the capital sexual battery, the 12-year-old juvenile became pregnant and gave birth to a child,” Pinellas Park police said. “Both the 12-year-old and newborn baby are healthy and receiving care at a local hospital.”

Detectives arrested Back at a home in St. Petersburg on July 17 and booked him into the Pinellas County Jail at 11 p.m.

Due to Back’s charge of capital sexual battery of a child under 12, he could potentially face the death penalty under Florida state law, should prosecutors seek it.

The State Attorney’s Office has not made any announcement in that regard as of this report.
