A Texas Christian University student may not be on campus this fall after ICE officials say he was deported to El Salvador on Tuesday.
Luis Andrade-Garcia, 20, was arrested June 28 in Tarrant County. Online court records reviewed by the Fort Worth Star-Telegram show he was charged with disorderly conduct and fleeing from a police officer.
Arlington police told Chron that an officer found Andrade-Garcia in his car around 10 p.m. June 27 near Meadowbrook Park, and the officer shined a light on the vehicle.
"When he did this, he could see a young man inside who was nude from the waist down," APD said in an email. "The young man got into the driver's seat, started the vehicle, and drove away."
A chase didn't occur, but the officer put out a description of Andrade's vehicle, which was found just a few hours later outside a home about a mile away.
"While in custody, an immigration hold was placed on Mr. Andrade-Garcia by the U.S. Department of Homeland Security (DHS)," Arlington PD said in the email. "He was transferred to the Tarrant County Jail on June 29."
According to Andrade-Garcia's attorney, who spoke with the Fort Worth Star-Telegram, the case was pleaded down to a class C misdemeanor. His attorney also told the outlet Andrade-Garcia paid about $200 in fines and court costs and was given an "immigration warning" that if he was not a citizen, the guilty plea could result in deportation.
Andrade's fraternity shared an Instagram post calling for his release, saying they fear the worst.
"The last time we spoke with Luis, he was detained at the Central Louisiana ICE Processing Center, also known as the La Salle Detention Facility in Jena, LA," the post's caption read. "Unfortunately, at this time we fear that Brother Andrade may have already been deported."
ICE confirmed Andrade-Garcia's arrest and deportation in an email to Chron.
"ICE Dallas took Luis Omar Andrade-Garcia, an illegal alien from El Salvador into custody July 10, following his arrest by the Arlington, TX, Police Department on charges of public lewdness and resisting arrest," an ICE spokesperson told Chron..
The statement went on to mention Andrade-Garcia entered the U.S. in 2009 near Hidalgo, Texas. An immigration judge ordered his removal in March 2010, the statement said.
TCU did not immediately respond to Chron's request for comment.
"Attending school in the United States does not confer lawful immigration status," an ICE spokesperson added. "The fact remains that Andrade-Garcia was present in the country illegally, never took steps to obtain legal status-including failing to apply for DACA-and was arrested for committing criminal offenses."
